JOB FUNCTION / SUMMARY:
Administers and manages the foreclosure department which consists
of handling foreclosure actions on active consumer and small
business real estate secured loans as well as deficiency actions
results from foreclosure.
ESSENTIAL DUTIES & RESPONSIBILITIES:
Supervises Loss Mitigation Foreclosure Specialists and administers
the foreclosure process for consumer and small business loans.
Responsible for ensuring that the department acts in compliance
with Fair Debt Collection Practice Act and CFPB guidelines.
Acts as the liaison for the Bank to the attorneys assigned to
effect the consumer foreclosures.
Provides accurate periodic reporting to management and responds to
internal requests timely.
Reviews all loan documentation prior to submitting to an attorney
for foreclosure including review of appraisals, title searches,
mortgages, notes, guarantees, NPV s, etc.
Assigns file to Foreclosure Specialist to engage outside counsel
and in some cases handles the foreclosure process on specific
Ensures that loan is charged down in accordance with bank
Reviews and approves partial charge downs, and/or final charge offs
within approval authority.
Reviews and approves all legal documents prepared by outside
counsel for posting or filing with the court.
Reviews appraisals on properties prior to sale date to determine
any issues or concerns over value.
Reviews and approves bidding instructions and coordinates
instructions with outside counsel and ensures a timely completion
of the foreclosure action.
Contacts counties on delinquent taxes and ensures all delinquent
taxes are paid.
Supplies any requested information on contested foreclosure
Responds to third party inquires; does research on payment and
Ensure all recoveries system notes are appropriate; timely and
descriptive on pending action.
Identifies need for filing of title claims.
Monitors outside counsel to ensure that the files are being worked
Attends mediations and depositions as needed.
Follows up with attorney to get Certificate of Tile, Trustee s Deed
and/or Sheriff s Deed from foreclosure sale and third party
foreclosure sale proceeds.
Follows up on sale notices and memorializes notices received from
inferior lien holders.
Ensures that the deficiency suit is filed on accounts with a
deficiency after the foreclosure sale is completed.
Ensures that Foreclosure Specialist are updating foreclosure logs
and Debt Manager as to the progress of the foreclosure or

carries out supervisory responsibilities in accordance with the
organization's policies and applicable laws. Responsibilities
include interviewing, hiring and training employees; planning,
assigning and directing work; appraising performance; rewarding and

MINIMUM REQUIRED EDUCATION, EXPERIENCE & KNOWLEDGE:
Associates degree and/or 5+ years of experience in banking,
finance, and/or mortgage servicing is required. Must have a

specific state foreclosures; e.g. affidavit process, demand,
